Source 44 LLC dba Source Intelligence takes the intellectual property rights of others seriously and requires that our Customers and their Authorized Users do the same. The Digital Millennium Copyright Act established a process for addressing certain claims of copyright infringement that may exist within Source Intelligence’s products and/or services.
Source Intelligence is a service provider as defined in 17 U.S.C. § 512, and this DMCA Policy sets out the designated procedure by which Source Intelligence receives and responds to notifications of claimed copyright infringement. This DMCA Policy forms part of, and is incorporated by reference into, the Source Intelligence Terms of Use, available at www.sourceintelligence.com/terms-of-use.
If you own a copyright or have the requisite authority to act on behalf of a copyright owner and wish to report a claim of possible infringement by a third-party on or in a Source Intelligence service, please send a written notice to our Designated Agent, identified below, that includes all the items below:
- A description of the copyrighted work that you claim is being infringed upon, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- A description of the material you claim is infringing and the resulting remedy sought, for example, for such to be removed or access to which you want disabled, along with any URL or other location address or identification of that material;
- Your address, telephone number, and email address;
- The following statement: “I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use, etc.)”;
- The following statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed”; and
- An electronic or physical signature of the owner of the copyright or a person authorized to act on the owner’s behalf.
Source Intelligence has designated the following agent to receive notifications of claimed infringement, and has provided the same information to the United States Copyright Office for inclusion in its electronic directory of designated agents. Please send your notice by one of the following means, and we will expeditiously take appropriate action, which may include removing or disabling access to the material claimed to be infringing:

If we remove or disable access to material in response to a notification of claimed infringement, we will take reasonable steps to notify the Customer or Authorized User who submitted or posted that material. If you believe your material was removed or disabled as a result of mistake or misidentification, you may send a written counter-notification to our Designated Agent that includes all of the items below:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled;
- The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled”;
- Your name, address, and telephone number; and
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside of the United States, for any judicial district in which Source Intelligence may be found, and that you will accept service of process from the person who submitted the notification of claimed infringement or an agent of that person.
If we receive a valid counter-notification, we will promptly provide a copy to the person who submitted the original notification and inform that person that we will restore the removed or disabled material in ten (10) business days. We will then restore the material not less than ten (10) nor more than fourteen (14) business days after receiving the counter-notification, unless the person who submitted the original notification first notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity.
Source Intelligence has adopted, and will reasonably implement, a policy of terminating in appropriate circumstances the accounts of Customers and Authorized Users who are repeat infringers of copyright. Source Intelligence maintains a record of the notifications of claimed infringement it receives and, in appropriate circumstances, will disable access to or terminate the account of any Customer or Authorized User who has been the subject of repeated valid notifications. This policy is referenced in, and enforced through, the Source Intelligence Terms of Use. This process does not limit our ability to pursue any other remedies we may have to address suspected infringement.
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for any damages, including costs and attorneys’ fees, incurred as a result of that misrepresentation. Please consider these consequences, and consult your own legal counsel if appropriate, before submitting a notification or a counter-notification.

Please identify the right you claim, the material or use at issue, the location of that material or use, the basis of your claim, and your contact information.
