On July 22, 2019, EU Directive 2015/863, better known as RoHS 3, came into affect. The update to the regulation adds 4 substances to the RoHS substances of very high concern list, and adds category 11 products. What does all this mean? Let’s break it down.

4 new substances 

RoHS previously had 6 substances of very high concern on their list. As mentioned above, RoHS 3 introduces four new substances, bringing the total to 10. All the new substances are phthalates and are mainly used as insulation plasticizers. The ten substances that RoHS covers are:

  1. Cadmium (0.01 %)
  2. Lead (0.1 %)
  3. Mercury (0.1 %)
  4. Hexavalent chromium (0.1 %)
  5. Polybrominated biphenyls (PBB) (0.1 %)
  6. Polybrominated diphenyl ethers (PBDE) (0.1 %)
  7. Bis(2-ethylhexyl) phthalate (DEHP) (0.1 %)
  8. Butyl benzyl phthalate (BBP) (0.1 %)
  9. Dibutyl phthalate (DBP) (0.1 %)
  10. Diisobutyl phthalate (DIBP) (0.1 %)

Category 11 products

RoHS 3 has also added Category 11 (catch-all) products. These products include electronic and electrical equipment not covered under the other categories such as 2-wheeled vehicles, electronic nicotine delivery systems (ENDS) such as e-cigarettes, cannabis vaporizers and vape pens. Electrical cables that are less than 250V working voltage are also included.

What is significant about the RoHS 3 update?

There’s a few things about the new RoHS 3 that are significant, and will be of interest to companies who are actively importing or selling products in the EU:

1. All four of these phthalates are also on the REACH list of SVHCs.

2. If you are part of the medical devices business sector, you have until July 22, 2021 to meet RoHS 3 compliance

2. RoHS 3 pertains to products placed on the market on or after July 22, 2019.
